Terms of Service

Welcome to Naily. By accessing or using our service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the service.

1. Service Description

Naily is an AI-powered nail design platform that generates nail art images based on text prompts. The service includes design generation, remixing, outfit matching, and a community gallery.

2. Eligibility

You must be at least 13 years old (or 16 in the EU) to use Naily. By using the service, you represent that you meet this age requirement.

3. Accounts

• You may use Naily without an account with limited daily generations.
• Creating an account gives you additional daily generations and the ability to save designs.
• You are responsible for maintaining the security of your account credentials.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

• Submit prompts intended to generate harmful, illegal, explicit, or offensive content
• Attempt to bypass usage limits or content moderation
• Use the service for any unlawful purpose or to violate any applicable law
• Reverse-engineer, scrape, or programmatically access the service without permission
• Upload images that contain illegal content or violate others' rights

5. AI-Generated Content & Ownership

• All designs are generated by artificial intelligence. AI-generated images are not considered original human artwork under current copyright law in most jurisdictions.
• Naily retains a platform license to all AI-generated designs, including the right to display them in the public gallery, use them for marketing, recommendations, and service improvement.
• Anonymous users: Designs generated without an account are owned entirely by Naily. No usage rights are granted.
• Free registered users: You are granted a personal, non-commercial, non-exclusive license to use designs you generate. You may save, share (with "Created with Naily" attribution), and use designs as reference for personal nail salon visits. You may not resell, redistribute, or use designs commercially.
• Super (paid) users: You are granted an extended, non-exclusive license including commercial use rights. You may use designs for social media, marketing, salon portfolios, and print. No attribution required. You may opt out of gallery inclusion to keep your designs private. You may not resell AI-generated images as standalone digital products or claim them as original human artwork.
• Gallery inclusion: By default, all designs may appear in Naily's public gallery and recommendation systems. Super users may opt out of gallery inclusion in their settings.
• AI-generated images may produce unexpected or imperfect results. Naily is not responsible for the specific output of any generation.
• Nail masters who recreate Naily designs in real life own their physical work. The digital design reference remains subject to these terms.

6. Content Moderation

All prompts are automatically moderated. We reserve the right to reject prompts or remove content that violates our acceptable use policy without prior notice.

7. Usage Limits

The service has daily generation limits that differ for anonymous and registered users. These limits may change at any time. Exceeding or attempting to circumvent these limits may result in temporary or permanent suspension.

8. Intellectual Property

• The Naily name, logo, platform design, and AI models are our intellectual property. You may not use our branding without written permission.
• The design gallery, recommendation algorithms, and generated content library are proprietary assets of Naily.
• Unauthorized scraping, bulk downloading, or systematic copying of designs from the platform is strictly prohibited.

9. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, Naily shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

11. Governing Law

These Terms are governed by the laws of the State of Israel. Any disputes shall be resolved in the courts of Tel Aviv-Jaffa, Israel.

12. Changes to These Terms

We may update these Terms at any time. Continued use of the service after changes constitutes acceptance of the updated Terms.
